Terms of Service

The agreement

QERYX (“QERYX”, “we”, “us”) provides a post-quantum encrypted messaging service. These Terms of Service, together with our Privacy Policy and Acceptable Use Policy, form the agreement between you and QERYX. If you do not agree, do not use QERYX. By creating an account or using the app, you agree to them.

Eligibility

You must be at least 17 years old to use QERYX. By using QERYX you represent that you meet this requirement and that your use does not violate any law applicable to you.

Your account and keys

QERYX does not require a phone number or email to create an account. Your identity is anchored by cryptographic keys held on your device. You are responsible for safeguarding your device, your recovery passphrase, and any backup you export.

There is no key-escrow and no master reset.

Because QERYX is zero-knowledge, we cannot recover your account, your messages, or your encrypted backup if you lose your device and your Secret Phrase. There is no password-reset path that could bypass your own keys. This is a security guarantee, not a limitation we can waive on request.

Price, tiers, and payment

This version of QERYX sells nothing. There is no in-app purchase, no subscription, and no card processor in the shipping build. An invited account carries every functional feature at no charge.

QERYX is a paid product by design, and the tier ladder is the roadmap for that. There is no advertising-supported free tier; you are the customer, never the product. Paid tiers unlock additional unilateral capabilities (for example, network features and tools). Paid tiers never downgrade the bilateral encryption parameters of any conversation — every account receives the same end-to-end security floor regardless of tier.

When purchases open, payments are processed by the billing system of the store you purchased through and by our card processor, under their own terms; the named register of subprocessors publishes in the Trust Center. Subscription renewal, cancellation, and refund handling follow the rules of the platform through which you purchased; refunds for store purchases follow that store’s policies.

Acceptable use

Your use of QERYX is subject to our Acceptable Use Policy. In short: do not use QERYX to harm others, to distribute material that is illegal in your jurisdiction, or to attack the service. Because we cannot read your content, enforcement of the AUP relies on account-level and reported-conduct signals, not on inspecting your messages.

Service availability

We aim for high availability and ship across multiple distribution channels so that no single store or network can silence the service. We do not guarantee uninterrupted availability. We may perform maintenance, deploy security updates, and adjust infrastructure as needed.

Security research

We welcome good-faith security research. If you discover a vulnerability, report it to security at qeryx.app using the keys and scope published on the bug bounty page. We will not pursue legal action against researchers acting in good faith who follow coordinated disclosure and avoid harming people or their data.

Intellectual property

QERYX, its names, logos, primitives, and documentation are the property of the operating entity. Using the service does not grant you a license to QERYX trademarks. Source available under the QERYX license is governed by that license, separate from these terms — see Open Source.

Disclaimers

QERYX is provided “as is” and “as available”. To the maximum extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement. No software is perfectly secure; we work to make QERYX as strong as the state of the art permits and publish our formal artifacts so the claims can be checked.

Limitation of liability

To the maximum extent permitted by law, QERYX is not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the service. Nothing in these terms limits liability that cannot be limited under applicable law. The precise liability cap and carve-outs will be finalized by counsel for the launch jurisdiction.

Termination

You may stop using QERYX and delete your account at any time from Settings → Account → Delete. We may suspend or terminate accounts that violate the Acceptable Use Policy or that we are legally required to act on. On termination, your server-side record is hard-deleted as described in the Privacy Policy.

Governing law and disputes

These terms are governed by the law of the jurisdiction of the QERYX operating entity, stated at launch. Where mandatory consumer-protection law in your country grants you rights these terms cannot override, those rights prevail. The dispute-resolution forum and any arbitration terms will be finalized by counsel before public launch.

Changes to these terms

We may update these terms. Material changes are announced via in-app banner at least 30 days before they take effect, mirroring the notification mechanism in the Privacy Policy. Continued use after the effective date constitutes acceptance.
